A three-member appellate court panel has dismissed Nnamdi Kanu’s appeal seeking relocation from Department of State Services (DSS) custody to Kuje Prison, following his conviction and life imprisonment sentence.

Delivering the lead judgment, Justice Boloukuromo Ugo stated that Kanu’s claims regarding violations of his fundamental rights to human dignity, quality healthcare, and religion were no longer feasible because he is now serving his sentence in Sokoto Prison.

“The substance of the case has become academic since Kanu’s counsel, Maxwell Opara, confirmed that his client is being held in Sokoto prison. The court cannot order a transfer to Kuje prison as previously sought,”
Justice Ugo said.

The judgment emphasized that Kanu had previously expressed a preference for prison custody, and having now been convicted and remanded in prison, his request could not be granted.

This appeal followed Justice Taiwo Taiwo’s July 3 ruling at the Federal High Court in Abuja, which had dismissed Kanu’s fundamental rights suit on the grounds that he failed to prove his claims.
